Buddy / Domestic Worker & Service Provider Agreement

Between:

BuddyApp (Pty) Ltd ("BuddyApp", "we", "us")

and

You, the Buddy (domestic worker or service provider) ("you")

1Introduction

This Service Provider Agreement ("Agreement") is entered into between BuddyApp and you, the Buddy. By completing your application, creating an account, or offering services on the BuddyApp platform, you agree to all terms in this Agreement. This Agreement is legally binding.

2Nature of the Relationship

Important Notice:

  • 2.1You are an independent contractor, not an employee of BuddyApp.
  • 2.2BuddyApp does not provide a salary, UIF, leave, sick pay, or employment benefits.
  • 2.3You choose your own working hours, jobs, and availability.
  • 2.4Each booking is a separate agreement between you and the Client, not BuddyApp.

3Requirements for Registration

You confirm that:

  • All information provided is true, accurate and complete.
  • You are legally allowed to work in South Africa.
  • You will provide any verification documents if requested.
  • You consent to BuddyApp conducting background or verification checks if needed.

4Professional Conduct & Obligations

You agree to:

  • • Perform all work professionally, safely and honestly.
  • • Treat Clients, their homes and belongings with respect.
  • • Arrive on time or notify Clients if delayed.
  • • Never steal, damage property, or work under the influence of alcohol or drugs.
  • • Follow safety rules and confidentiality at all times.
  • • Communicate respectfully and professionally.

5Use of the BuddyApp Platform

You agree to:

  • Accept only jobs you can perform safely and competently.
  • Never accept or request off-platform payments.
  • Use the app to start, complete and confirm all bookings.
  • Keep your profile, documents, and banking details updated.
  • Not create fake or duplicate accounts.

6Payments & Payouts

Payment Terms:

For BuddyUp (Buddy/Domestic Worker) Services:

  • • After job completion, BuddyApp pays you your payout amount minus platform fees.
  • • Payouts follow BuddyApp's payout schedule (e.g., weekly).
  • • Payouts may be delayed in cases of disputes, fraud concerns, or policy violations.

For Professional Service Providers:

  • • You handle payments directly with your customers.
  • • BuddyApp provides the platform for visibility and customer connections.

All providers: You are responsible for your own taxes.

7Ratings, Reviews & Performance

Performance Standards:

  • • Clients may leave ratings and reviews based on your service.
  • • Repeated complaints, low ratings or misconduct may lead to suspension or removal.
  • Serious misconduct (theft, harassment, threats, violence) results in immediate removal and possible legal action.

8Cancellations & Penalties

  • You must follow the official BuddyApp Cancellation Policy.
  • Repeated cancellations or last-minute cancellations may result in penalties, warnings, suspensions, or removal.

9Safety & Liability

Important:

  • • You work at your own risk.
  • • BuddyApp is not responsible for injuries, theft, damages, or losses during a booking.
  • • You acknowledge the risks of entering a Client's home.

10Confidentiality

You agree not to:

  • • Share Client information
  • • Contact Clients outside the app
  • • Discuss private Client matters publicly
  • • Store or misuse Client details

Confidentiality is mandatory under POPIA.

11POPIA Consent

By accepting this Agreement, you consent to BuddyApp:

  • Collecting, storing and processing your personal information
  • Using your details for bookings, payouts and identity verification
  • Sharing limited information with Clients only when necessary

BuddyApp will protect personal information as required by POPIA.

12Suspension & Termination

BuddyApp may suspend or remove you without notice if:

  • • You violate this Agreement
  • • You commit theft, harassment, fraud, or misconduct
  • • You falsify information
  • • You accept off-platform payments
  • • You repeatedly cancel bookings

You may request account closure at any time.

13No Guarantee of Jobs

BuddyApp does not guarantee:

  • • A minimum number of jobs
  • • Consistent work or income
  • • Availability of Clients

Clients freely choose Buddies.

14Disputes

BuddyApp may help mediate disputes but is not responsible for losses, damages or claims arising from a booking.

15Acceptance

By clicking "I Agree" during your application, you confirm that you:

  • Have read this entire Agreement
  • Understand it fully
  • Accept all rules and obligations
  • Agree you are an independent contractor, not an employee

This Agreement becomes effective immediately once accepted.
